This Privacy Policy (the “Policy”) explains how Seekye Capital, LLC d/b/a “Seekye Capital”, its subsidiaries, affiliates, and brands (together, “Seekye Capital”) collect, use, manage and share your personal information and sets out our privacy practices. In this Policy, “we,” “us” and “our” refers collectively to Seekye Capital and its affiliates and/or delegates and investment funds and accounts managed, advised, or administered by Seekye Capital.

Your access to the Seekye Capital website and affiliated sites is governed by our Terms of Use (“Terms”). In the event of a conflict between the Policy and the Terms, the latter will govern.

This Policy contains separate components with various rights and obligations – and it may apply to you differently depending on factors such as where you are located or where you reside. The Policy applies without limits to any individual or entity that accesses or uses the Seekye Capital website or otherwise provides any personal information to Seekye Capital. If you do not, or cannot, agree to these terms, you are not permitted to access the Seekye Capital website.

You agree and understand that when you access the Seekye Capital website, or you provide us with any information, you agree to the terms of this Policy. Seekye Capital reserves the right to change this Policy from time to time at its sole and absolute discretion. In the event we do make any modifications, we may take reasonable steps to notify you of the changes. For example, notification may be made by including the effective date of the new privacy policy alongside its posting. If you do not agree to this version of the Policy or if in the future you object to modifications, your only recourse is to immediately stop accessing the Seekye Capital website and to cease all interactions which provide us with information. Personal information does not include:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information excluded from the CCPA’s scope, like health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data.
  • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

Seekye Capital may collect any of the following personal information as follows:

  • Personal or Business Information: Or “PI”, includes names, addresses, telephone numbers, email addresses, social media handles or username(s), account information, passwords, date of birth, and any other content or information that you provide us via messages, emails, telephone, or video call(s), or via the Sites or to evaluate and explore potential business relationships.
  • Payment Information: We may also collect banking, credit card and/or debit card information for transaction and billing purposes which includes cardholder transaction data and other information from your card such as account numbers, card number(s) and expiration date, CVV codes, the billing address to which you register the payment information, etc.
  • Interactive Features: From time to time, we may invite you to participate in a survey, fill out a questionnaire or help us by giving us feedback and input on a new product or feature. We and others may collect and use the information you provide us, or we collect through these interactive features. This Policy does not apply to information you provide to us in a manner that is “public” – meaning it can be seen or accessed by third parties.
  • Job Applicants: Any information you provide to us in reply to a job posting or application, whether posted on our Sites or a third-party site on behalf of Seekye Capital.
  • Technical Data and Information: We may collect information that is tied to you as a user (i.e. – mobile service or internet service provider), location information (i.e. – GPS location, actual or derived IP address, MAC ID or UDID) and information collected from your or your vendor servers (i.e. – http headers, operating system, language settings) and information on your internet browsing history and the way(s) in which you interact with your Sites.
  • Small text files called “cookies” which are placed on your computer, single pixel GIF image files called “web beacons” and other technological means including pixels with unique identifiers placed on our Sites or in our HTML-based email newsletters. Seekye Capital uses cookies and similar technologies to personalize content, provide social media features, analyze our traffic, and improve our services.   • Other: We also collect information that is anonymous and/or cannot be tied back to you because it has been collected in the aggregate.

  1. How Seekye Capital Uses Your Information

We use the information we collect for a variety of purposes including but not limited to:

  • Sending administrative information, such as updates and security alerts;

  • Conducting research and analysis to improve our services;

Seekye Capital may share your information with

This Policy does not apply to information, content, business information, concepts or inventions that you share with us via email or via telephone. When we use a third parties to collect, analyze or process any of your personal information, we typically demand their compliance with this Policy and other appropriate confidentiality provisions – however, you understand and agree that Seekye Capital does not make any representations or warranties that such third parties will comply.  

Seekye Capital may use third party network advertisers and/or services that measure and provide us with data about our website traffic or other software as a service (“SASS”) and because they are not part of Seekye Capital, such third parties have their own terms of use and privacy policies. You understand and agree that we have no control over, and that Seekye Capital makes no representations or warranties regarding the information and data handling practices of such third-parties.

Seekye Capital implements appropriate technical and organizational measures to protect your personal information from unauthorized access, use, or disclosure. However, no method of transmission over the Internet or method of electronic storage is completely secure and we cannot make any such guarantees.

We may provide your Personal Information to our affiliates and to firms that assist us in servicing your account and have a need for such information.  Such affiliates and firms we will share your Personal Information with include, but are not limited to:

  • The fund administrator, and its respective affiliates for the purposes set out in this Policy, which include:
    • managing our relationship with you;
    • delivering the services you require;
    • managing your investment;
    • supporting and administering investment-related activities;
    • complying with applicable investment laws and regulations;
    • delivering and facilitating the services needed to support our business relationship with you; and
    • supporting and administering investment-related activities.
  • The tax authorities, to comply with applicable laws and regulations; and where required by tax authorities (who, in turn, may share your personal data with other tax authorities),
  • Our lawyers, auditors and other professional advisors for purposes of:
    • providing you with investment-related services; and
    • seeking advice on, and complying with, legal and regulatory requirements or legal rights and obligations.

We may share Personal Information for purposes including the following:

  • administering or managing a Seekye Capital investment or fund;
  • processing your subscription and investment in a Seekye Capital investment or fund, such as entering your information in the register of shareholders;
  • sending you statements relating to your investment;
  • providing advisory services to you, opening an account for you and/or processing a transaction for your account;
  • undertaking investor due diligence including anti-money laundering and counter-terrorist financing checks, including verifying the identity and addresses of our investors (and, where applicable, their beneficial owners);
  • sanctions screening and complying with applicable sanctions and embargo legislation;
  • complying with requests from regulatory, governmental, tax and law enforcement authorities; and
  • responding to court orders and legal investigations.

In exceptional circumstances, we will share your Personal Information with regulatory, prosecuting and other governmental agencies or departments, and parties to litigation (whether pending or threatened) in any country or territory, as and to the extent required by law.

We will only process your personal data in pursuance of our legitimate interests where we have considered that the processing is necessary and, on balance, our legitimate interests are not overridden by your legitimate interests, rights or freedoms.

  • Nevada Residents: This Policy applies to all those who interact with our Sites or use or Services, including Nevada residents.   • Non-US Users: Our Sites and Services are not intended or directed to EU Users. If you are not based in the United States (“US”), please be noticed that the information we may collect about you is and will be subject to US laws (except for applicable mandatory provisions) and that such laws may be different and provide different protections than the laws of your home country. By using our website, you consent to the transfer of your personal data to the United States and the processing of that data as described in this Policy.

Seekye Capital may update this Policy from time to time. In the event the Policy is update, the updated version will be indicated by an updated ‘Effective Date’ and will be effective as soon as it is accessible.
